Fabravio Terms of Service

Version of 01.11.2026

This is an English translation. The binding version is the Polish one, available at fabravio.pl/regulamin.

§ 1. General provisions

  1. These Terms set out the rules for using the Fabravio website available at fabravio.pl and fabravio.com (the Service), including creating an Account, using the Free, Basic and AI Plans and AI credits, concluding and ending the Subscription Agreement, and payments.
  2. The service provider is Michał Wdaniec, trading as Syjulene Michał Wdaniec, Bodzanów 330, 32-020 Bodzanów, Poland, tax ID (NIP) 6321892353, REGON 545315606, entered in the Polish Central Register and Information on Economic Activity (CEIDG) kept by the minister responsible for the economy (the Provider).
  3. Contact: email info@fabravio.pl, phone +48 459 630 406, postal address as in section 2. The address info@fabravio.pl is also the point of contact for Member State authorities, the European Commission, the European Board for Digital Services and Users under the Digital Services Act (Regulation (EU) 2022/2065); we communicate in Polish and English.
  4. These Terms are the terms referred to in Article 8 of the Polish Act of 18 July 2002 on providing services by electronic means. They are available free of charge on the "Terms" page in a form that allows them to be downloaded, stored and printed. A buyer of the Basic Plan or the AI Plan, or of an AI credits top-up, receives the Terms as in force at the time of purchase, attached to the purchase confirmation email.
  5. The Service is under active development: the Provider regularly adds and changes features. We recommend keeping copies of important Projects in a file (the "Export" feature).

§ 2. Definitions

  1. User — a person using the Service, with or without an Account.
  2. Consumer — a natural person concluding an agreement with the Provider that is not directly connected with their business or profession.
  3. Sole trader — a natural person concluding an agreement with the Provider in connection with their business (e.g. buying the Basic Plan or the AI Plan with an invoice to their tax ID).
  4. Company — a User who is not a natural person (e.g. a company, foundation or association).
  5. Account — a User's individual account in the Service, created with an email address and password or with a Google or Facebook account.
  6. Project — a furniture design (e.g. a kitchen) created by the User in the Service, including the room layout, cabinets, materials, cut list, hardware list and cost estimate.
  7. Free Plan — the free scope of services available to every Account.
  8. Basic Plan — the paid scope of services, billed monthly (Basic monthly) or yearly (Basic yearly).
  9. AI Plan — the paid scope of services that includes all services of the Basic Plan plus plan credits (§ 10a), billed monthly (AI monthly) or yearly (AI yearly). The provisions of these Terms on the Basic Plan also apply to the AI Plan unless these Terms provide otherwise.
  10. AI credits — a balance in the Account, expressed in zloty, from which AI visualizations and the AI designer are paid for (§ 10a, § 10b). AI credits are not electronic money, cannot be exchanged for money or transferred to another Account, and can be used only for AI visualizations and the AI designer in the Service.
  11. Subscription Agreement — an agreement for the supply of a digital service under the Basic Plan or the AI Plan, concluded for an indefinite period, with billing periods — with automatic renewal, or without it when the User pays for each next period themselves (§ 7(6)).
  12. Billing period — the month or year for which the Basic Plan or AI Plan fee is charged (§ 7(3)).
  13. AI visualization — an image generated from a Project view by external artificial-intelligence model providers (§ 10(4)).
  14. AI designer — a service that creates and changes a Project from the User's conversation with an external provider's artificial-intelligence model (§ 10b).
  15. Payment operator — PayU S.A., Grunwaldzka 186, 60-166 Poznań, Poland, KRS 0000274399.

§ 3. Services

  1. The Provider offers the following services by electronic means:
    1. without an Account: access to the Service's content (guides, information), calculators (e.g. the hinge calculator) and the 3D Planner, with the Project saved only in the User's browser;
    2. an Account on the Free Plan (§ 5, § 6(1));
    3. the Basic Plan and the AI Plan under the Subscription Agreement (§ 6–9) and AI credits top-ups (§ 10a);
    4. the "Report a bug" form and email contact;
    5. emails relating to the Account, security and the Subscription (confirmations, invoices, payment and change notices). The Provider sends marketing emails only with separate, voluntary consent, which can be withdrawn at any time (link in the email or by writing to info@fabravio.pl).
  2. Services without an Account and an Account on the Free Plan are free of charge. The agreement for services without an Account is concluded when the User starts using the Service and ends when they leave it. The Account agreement is concluded when registration is confirmed and runs for an indefinite period; the User may end it at any time by deleting the Account (§ 5(6)).
  3. The Provider does not personalize prices on the basis of automated decision-making.

§ 4. Technical requirements and security

  1. To use the Service you need a device with internet access and a current version of Chrome, Edge, Firefox or Safari with JavaScript, cookies and WebGL (for the 3D Planner) enabled, and — to create an Account — an active email address.
  2. The 3D Planner works best on a computer. On phones and tablets some features may be limited.
  3. The Provider protects registration and sign-in against automated abuse (Cloudflare Turnstile).
  4. Using the internet involves risks such as malware, phishing (impersonating the Service or the Payment operator) and password theft. The Provider never asks for your password or card details by email or phone. We recommend a unique password and up-to-date software.
  5. The Provider supplies updates to the Service, including security updates, for the whole term of the agreement. Updates are deployed automatically on the Service's side and require no action from the User other than reloading the page.

§ 5. Account

  1. An Account may be created by a person aged 16 or over. A person aged 16–18 may use an Account on the Free Plan (an everyday agreement of minor importance). Buying the Basic Plan or the AI Plan, or topping up AI credits, requires being of age and having full legal capacity.
  2. Registration requires an email address and password (at least 8 characters) or signing in with Google or Facebook, accepting these Terms and — when registering by email — confirming the email address via a link. Marketing consent is voluntary and does not affect the ability to create an Account.
  3. The User keeps their sign-in details confidential and does not share the Account with others. One person may have one Account.
  4. When signing in with Google or Facebook, the Provider receives from that provider the email address and basic profile data (first name, last name, profile picture) within the scope of the consent given in its window; it does not receive the Google or Facebook account password. A User signing in with Google or Facebook may also set a password for email sign-in. Removing access in the Google or Facebook account settings does not delete the Account in the Service.
  5. In the Account settings the User can change the password, the email address (the change must be confirmed on both addresses) and delete the Account.
  6. Deleting the Account is irreversible and ends the Account agreement with immediate effect. Projects, shares and links, AI visualizations and invoice details are deleted. If the User has an active Basic Plan or AI Plan, the Subscription Agreement ends when the Account is deleted, no further payments are taken and saved payment methods are removed at the Payment operator. The Provider refunds a proportional part of the fee for the days from the Account's deletion to the end of the paid Billing period (rounded up to the nearest grosz) within 14 days, as described in § 9(5). A paid next period that has not started yet (§ 8(2a)) is refunded in full. AI credits are forfeited when the Account is deleted and are not refunded, including purchased credits (§ 10a(6)). Before the Account is deleted, the Service shows the balance of purchased credits and asks for confirmation. To keep the Basic Plan or the AI Plan until the end of the period instead, simply turn off automatic renewal (§ 8(2)). Deleting the Account does not take away the right to withdraw from the Subscription Agreement within the period in § 11 or the rights in § 12.
  7. Invoices and billing records are kept after the Account is deleted for the period required by tax law (see the Privacy policy).
  8. The Provider may block or delete an Account only in the cases and under the procedure in § 13.

§ 6. Free, Basic and AI Plans

  1. The Free Plan includes: calculators, the 3D Planner (design, cut list, hardware list, cost estimate, export) and saving Projects to the Account — up to 5 active Projects. AI visualizations and the AI designer are paid for with AI credits (§ 10a) — on the Free Plan with trial credits (§ 10a(3)) and with any purchased credits left on the balance (§ 10a(6)).
  2. The Basic Plan additionally includes:
    1. unlimited Projects on the Account;
    2. sharing Projects with other Users (view, view and copy, co-editing) and via links (§ 10(2));
    3. AI visualizations and the AI designer paid for with AI credits (§ 10a, § 10b) — on the Basic Plan with trial credits (§ 10a(3)) and with any purchased credits left on the balance (§ 10a(6)).
  3. Prices (gross, including 23% VAT): Basic monthly — PLN 14.90 per month; Basic yearly — PLN 119.88 per year (equivalent to PLN 9.99 per month, paid upfront for the whole year); AI monthly — PLN 49.00 per month; AI yearly — PLN 529.20 per year (equivalent to PLN 44.10 per month, paid upfront for the whole year; 10% less than twelve monthly payments). Apart from the Plan fees and voluntary AI credits top-ups (§ 10a(6)), there are no other fees or costs. Current prices are shown on the "Pricing" page. The User pays the price applicable at the time of purchase, subject to changes under § 8(5).
  4. Returning to the Free Plan (after the Subscription, the grace period or a plan granted by the Provider ends): Projects are not deleted. The 5 oldest Projects stay active; the rest become inactive (they can be opened and exported, but changes cannot be saved) until the Basic Plan or the AI Plan is bought again. Shares and links are suspended and come back when the Basic Plan or the AI Plan is reactivated. AI visualizations remain viewable, and purchased credits stay on the balance (§ 10a(6)).
  5. The Provider may grant a User the Basic Plan or the AI Plan free of charge (e.g. for testing or a promotion), for a fixed or indefinite period. The provisions on payments, renewal and withdrawal (§ 7–9, § 11) do not apply to such a plan; when it ends, section 4 applies.
  6. Payments are accepted only from Users in Poland (with a Polish invoice address).
  7. If the Provider announces a price reduction, it will also show the lowest price of the Plan in the 30 days before the reduction.
  8. The AI Plan includes all services of the Basic Plan (section 2) plus plan credits in the amount set in the price list, currently PLN 49 for each monthly period (§ 10a(4)), from which AI visualizations and the AI designer are paid for. AI credits can be topped up on the AI Plan (§ 10a(6)).

§ 7. Subscription Agreement — conclusion and renewal

  1. To buy the Basic Plan or the AI Plan, a User signed in to their Account:
    1. chooses the option (monthly or yearly) on the "Pricing" page;
    2. provides invoice details — private individual: full name (address optional); company: tax ID, name and address (details may be filled in from the Polish VAT taxpayer register);
    3. chooses how to pay — automatic renewal by payment card or BLIK, or a single payment for one period (section 6);
    4. accepts these Terms, including the Subscription terms (and, with automatic renewal, the automatic renewal terms);
    5. expressly requests that the service start before the withdrawal period ends and confirms they acknowledge the consequences of withdrawing after the service has started (§ 11(3));
    6. clicks the "Pay [amount]" button, which places an order with an obligation to pay.
  2. The Subscription Agreement is concluded when the Payment operator confirms the payment. The Basic Plan or the AI Plan is switched on immediately after that confirmation. The Provider sends to the Account's email address a confirmation of the agreement with the statements made and the Terms as in force at the time of purchase (a durable medium).
  3. The agreement is concluded for an indefinite period and has no minimum term. The first Billing period starts at the time of purchase. Each period lasts a month or a year and ends on the same day of the month as the purchase date (or on the last day of the month if that day does not exist).
  4. Automatic renewal: on the day the Billing period ends, the Provider, through the Payment operator, charges the fee for the next period to the saved payment method, with no further action from the User. The amount and the date of the next charge are shown on the "Subscription" page in the Account.
  5. By accepting the Subscription terms, the User agrees to recurring charges to the chosen payment method under section 4 until automatic renewal is turned off or the Subscription otherwise ends.
  6. Paying for one period (no automatic renewal): at purchase the User may choose "Pay for one period". The User then pays once on the Payment operator's payment page with the methods offered there; no payment method is saved and the fee for the next period is not taken automatically. The price is the same as with automatic renewal. In this option the Subscription Agreement ends when the paid Billing period ends, unless the User pays for the next period (§ 8(2a)).

§ 8. Changes, automatic renewal and end of the Subscription

  1. Switching options (monthly ↔ yearly) takes effect from the next Billing period — the fee for the new option is charged on the renewal date. The switch can be reversed until then. Switching options does not conclude a new agreement.
  2. Turning off automatic renewal: the User may turn off automatic renewal at any time on the "Subscription" page (the "Automatic renewal" switch) or by writing to info@fabravio.pl. Turning it off is notice of termination of the Subscription Agreement effective at the end of the current Billing period: the Basic Plan or the AI Plan works until then, no further fee is taken automatically, and the Account then returns to the Free Plan (§ 6(4)) unless the User pays for the next period (section 2a). Until the end of the period renewal can be turned back on; if the User has no saved payment method, this requires adding one (§ 9(2)). The Provider confirms by email that renewal has been turned off.

2a. Paying for the next period: while automatic renewal is off, the User may pay once for the next Billing period on the "Subscription" page — during the current period and at most one period ahead. The next period starts when the current one ends, and the fee equals the renewal fee (subject to section 5). Paying for the next period extends the Subscription Agreement and does not conclude a new agreement. Until the paid period starts, the User may give it up by writing to info@fabravio.pl — the Provider then refunds the whole fee for that period (§ 9(5)). If the next period is not paid before the current one ends, the Basic Plan or the AI Plan ends and the Account returns to the Free Plan (§ 6(4)). A payment for the next period started before the current period ends and booked after it extends the Subscription Agreement: the next period runs from the end of the current one if the payment is booked within an hour, and otherwise from the moment it is booked. A purchase made after the Account has returned to the Free Plan is a new purchase (§ 7(1)). While the next period is paid, switching options or plans (sections 1 and 7) is possible only once that period has started. 2b. Payment reminders: while automatic renewal is off, the Provider sends an email reminder 7 and 3 days before the Billing period ends and on its last day, unless the next period is already paid. The User may stop the reminders with the link in the email or on the "Subscription" page; doing so does not change the consequences in section 2a.

  1. Turning off automatic renewal during the grace period (§ 9(3)) ends the Basic Plan or the AI Plan immediately, as the last paid period has already ended; no fee is charged for the grace period.
  2. No refund is given for the unused part of a Billing period after automatic renewal is turned off, subject to § 5(6), section 2a, § 11, § 12, § 13(6) and section 6 below.
  3. Price changes to the Basic Plan or the AI Plan: the Provider notifies Users with an active Subscription by email at least 30 days before the change. The new Plan price applies to an existing Subscription from the first renewal that falls at least 30 days after the User is notified by email, and not earlier than the day from which the new price applies; until then the User may turn off automatic renewal at no extra cost. Price reductions may apply immediately. A new price for AI visualizations applies only to visualizations ordered after it takes effect; the price is always shown before ordering.
  4. If the Provider stops offering the Basic Plan, the AI Plan or the whole Service, it will notify Users at least 30 days in advance, enable Projects to be exported and refund the proportional part of the fee for the unused Billing period.
  5. Upgrading from the Basic Plan to the AI Plan. A User with an active Basic Plan may upgrade to the AI Plan at any time. The upgrade takes effect when the payment is booked; the new AI Plan Billing period runs from that moment. The fee for the first AI Plan period is reduced by the value of the unused part of the paid Basic Plan period, calculated in whole calendar days (Polish time): the fee actually paid for the current Basic period × the number of days left until the end of the period ÷ the number of days in the period, rounded down to the nearest grosz; the day of the upgrade counts as used. A Basic Plan granted by the Provider free of charge does not reduce the fee — the first AI Plan period is charged at full price. Basic yearly can be upgraded only to AI yearly. An upgrade is not possible during the grace period (§ 9(3)). When upgrading, the User chooses how to pay: by card or BLIK with automatic renewal of the AI Plan, or once on the Payment operator's page — the AI Plan then does not renew automatically (§ 7(6), § 8(2a)). Unused trial credits from the Basic Plan are forfeited at the upgrade. Switching from the AI Plan to the Basic Plan takes effect from the next renewal (like switching options in section 1).

§ 9. Payments, invoices, failed payments

  1. Payments are handled by the Payment operator. Available methods: payment card (Visa, Mastercard) and BLIK. Card details are entered in the Payment operator's form and never reach the Provider; the Provider receives only a payment token and the masked card number. With BLIK, the User approves in their banking app further payments without a code (BLIK recurring payment); this approval can be removed in the banking app at any time, which stops further charges. Top-ups of AI credits (§ 10a(6)) are single payments made on the Payment operator's payment page with the methods offered there; no payment method is saved in the process. Payments for one period (§ 7(6)), for the next period (§ 8(2a)) and the single payment during the grace period (section 3) are made the same way.
  2. Changing the payment method on the "Subscription" page: to verify a new method, the Provider charges PLN 1.00 and immediately (usually within minutes) orders its refund. During the grace period, instead of PLN 1.00, the new method immediately pays the overdue fee.
  3. Failed renewal payment (grace period): if the fee for the next period cannot be taken, the Basic Plan or the AI Plan keeps working, the Provider informs the User by email and retries 1, 3 and 7 days after the renewal date (the grace period lasts 7 days). During this time the User may change the payment method, pay once for a new Billing period running from the payment date (automatic renewal is then turned off) or turn off automatic renewal (§ 8(3)). If the last attempt fails, the Subscription Agreement expires and the Account returns to the Free Plan (§ 6(4)). The Provider charges no fees or interest for the grace period.
  4. Invoices: the Provider is an active VAT payer and issues an invoice for every payment (except the refunded PLN 1.00 verification payment). Invoices are issued in the Polish National e-Invoicing System (KSeF). The User receives a PDF rendering of the invoice (with the KSeF number and QR code) by email — to the Account's address or a nominated invoice address — and can download it on the "Subscription" page. An invoice for a buyer with a tax ID is also available to them in KSeF. Invoice details can be changed before the next payment; an issued invoice keeps the details as at the date of issue.
  5. Refunds (after withdrawal, an upheld complaint or in the cases in § 5(6), § 8(2a), § 8(6) and § 13(6)) are made using the same payment method the User paid with, unless the User expressly agrees to another method at no cost to them — without undue delay and no later than 14 days — and the Provider issues a corrective invoice.

§ 10. Projects, sharing, AI visualizations and Service output

  1. Rights to Projects: Projects belong to the User; the Provider acquires no rights to them. The User grants the Provider a non-exclusive, free licence to store, copy, process and display Projects to the extent necessary to provide the services (including sharing, AI visualizations and the AI designer at the User's request), for as long as the Project is stored in the Service. The Provider does not use Projects to train AI models and does not share them with anyone without the User's instruction.
  2. Sharing (requires the Project owner's Basic Plan):
    1. with other Users by email address, with "view", "view and copy" or "co-edit" access (co-editing also requires the Basic Plan on the recipient's side — without it the recipient can only view);
    2. via three links ("view", "materials", "full"). Anyone who has a link can see the Project to the extent of that link without signing in. A link can be reset at any time, which invalidates the previous one.
  3. The User decides who to share a Project with and to what extent, and is responsible for that sharing. A recipient without "co-edit" access cannot change the owner's Project. A copy saved by a recipient is the recipient's Project; the rights of the author of the original are unaffected.
  4. AI visualizations: at the User's request, an image of the Project view from the 3D Planner, a short description of its elements and any instruction from the User are sent to an external intermediary (fal.ai — Features & Labels, Inc., USA) and to the AI model provider named in the Privacy policy solely to generate the image. An AI visualization is for illustration only — it may differ from the Project (dimensions, proportions, materials, elements added or omitted). The Project is always the source of truth for dimensions and construction. Visualizations are kept with the Project until the owner deletes them or the Project is deleted. Any rights in AI visualizations belong to the User to the extent they arise; the Provider claims no rights in them. AI visualizations are marked as generated by AI (a label in the Service, file metadata and a caption on the downloaded image).
  5. The Provider may apply technical limits that protect the Service from abuse (e.g. the number of AI visualizations within a short time) and do not restrict normal use. Introducing a limit that restricts normal use of AI visualizations within the available AI credits is a change to these Terms (§ 16).
  6. Nature of the Service's output: cut lists, hardware lists, cost estimates, calculators and the Service's suggestions are aids. They rely on the data entered by the User, simplified assumptions and indicative material prices (wholesaler prices may change). Before ordering materials, cutting boards or installing, check the dimensions, compatibility with manufacturers' data sheets (e.g. for hardware and appliances) and the conditions on site. The appliance catalogue contains representative values, not the installation sheets of specific models.

§ 10a. AI Plan and AI credits

  1. Every AI visualization is paid for with AI credits. The price depends on the quality level: "Quick preview" or "High quality"; a refinement of an existing visualization ("Refine") costs the same as a visualization of the same quality. Current prices are given in the price list and on the order button — before clicking, the User sees the price and the available balance. The visualization is paid for from their own AI credits by the person who orders it, even if the Project has been shared with them.
  2. The fee is taken from AI credits when the visualization is ordered, before the data is sent for generation. If generation fails (provider error, timeout), the amount taken is returned to the balance automatically (as credits valid for 7 days if the credits taken have already expired in the meantime). A result that has been produced is performance of the service even if it contains inaccuracies or misreads the Project (§ 10(4)) — in that case AI credits are not refunded, subject to § 12. Deleting a visualization does not return AI credits. If the balance is not enough for the chosen visualization, the order is not accepted; the Service shows the missing amount and the ways to top it up.
  3. Trial credits are free and are meant for trying AI visualizations and the AI designer before buying the AI Plan: (1) on the Free Plan — one-off, granted at the first attempt to order an AI visualization or a paid AI designer action, valid for the number of days shown in the Service (currently 30); (2) on the Basic Plan — in each monthly period, in the amount given in the price list. Unused trial credits are forfeited at the end of their validity period.
  4. Plan credits: on the AI Plan, the User receives AI credits in the amount given in the price list (currently PLN 49) for each monthly period, counted from the day the Plan is bought — also when paying for a year upfront, in which case plan credits are granted every month, not upfront for the whole year. Unused plan credits are forfeited at the end of the monthly period for which they were granted.
  5. AI credits are used in this order: first the credits with the earliest expiry date (plan credits and trial credits), then purchased credits.
  6. Purchased credits: a User with an active AI Plan may buy additional AI credits in the packages shown in the Service; the Provider adds a free bonus to some packages. Purchased credits (with the bonus) have no expiry date while the Account exists and can also be used after the AI Plan ends. Purchased credits cannot be exchanged for money or refunded, subject to the User's rights under § 12 and mandatory law. The invoice is issued for the amount paid; the bonus is free.
  7. Before buying a top-up, the User consents to the AI credits being made available immediately after the payment is booked and acknowledges that from that moment they lose the right of withdrawal (§ 11). The Provider sends confirmation of the consent by email.
  8. The AI credits balance, its breakdown and the history of all operations (grants, top-ups, charges, refunds, forfeitures) are available in the Account on the "AI credits" page.

§ 10b. AI designer

  1. The AI designer is available to a User signed in to an Account on any Plan. The User chooses the type of furniture (kitchen, wardrobe, walk-in wardrobe or other furniture), describes what they need in a conversation with an artificial-intelligence model and may paste in their own material (a description, measurements, notes). On that basis the Service creates a Project, which the User opens and edits in the 3D Planner. An existing Project can be changed with the "Change with AI" command in the 3D Planner. At this stage the AI designer does not accept files or links.
  2. At the User's request, the conversation, the pasted material, the requirements gathered and — when an existing Project is changed — a description of that Project are sent to the external AI model provider named in the Privacy policy solely to prepare the reply and the Project. Personal data that is not needed to design the furniture should not be entered in the conversation. The conversation is kept in the Account until the Account is deleted.
  3. The AI designer is paid for with AI credits (§ 10a), on the Free and Basic Plans also with trial credits (§ 10a(3)). Every action that uses the AI model is charged: analysing the pasted material, a reply in the conversation, a summary of the requirements, generating a Project or changing it. The fee depends on the AI model's actual usage for the action: the model provider's cost converted into zloty, multiplied by the Provider's mark-up (plus a fixed fee per action, if the Provider has set one) and rounded up to the full grosz. Each action is a single charge to AI credits, shown in the history on the "AI credits" page (§ 10a(8)). Before an action, the Service shows its approximate cost; the fee may differ from it. Actions that do not use the AI model (e.g. choosing the type of furniture, correcting the requirements in the panel) are free.
  4. Unlike § 10a(2), the fee is taken after the action is performed. If the balance does not cover the approximate cost, the action is not started; the Service says so and shows the ways to top up AI credits. If, when the action is settled (e.g. generating a Project), the balance turns out to be lower than the fee, only the available amount is taken — the User owes the Provider nothing on that account. If, for technical reasons (provider error, timeout), the User has received neither a reply nor a Project, no AI credits are taken.
  5. The AI designer may reply that the requested furniture or arrangement cannot be designed from the 3D Planner's units or reconciled with the other requirements — it then explains the limitation or presents a summary of the requirements instead of a Project. Such a reply, given after the AI model has attempted to prepare the Project, is also a performed action and is charged. A reply or Project that has been produced is performance of the service even if it is unsatisfactory, inaccurate or misreads the requirements, which follows from the way AI models work — in that case AI credits are not refunded, subject to § 12.
  6. A Project prepared by the AI designer is a proposal to be checked. Before ordering materials, furniture or appliances, the User checks the dimensions, the layout and the appliance recesses in the 3D Planner, and their compatibility with the installation sheets of the chosen appliance models (§ 10(6)). The Project belongs to the User (§ 10(1)), counts towards the Project limit (§ 6(1)) and can be edited like any other Project.

§ 11. Right of withdrawal

  1. A Consumer and a Sole trader may withdraw from the Subscription Agreement within 14 days of its conclusion without giving a reason. The Provider grants this right to Sole traders contractually, without examining whether the agreement is of a professional nature for them.
  2. To withdraw, it is enough to send a statement by email to info@fabravio.pl or by post to the Provider's address, for example using the model form in Appendix 1 (not mandatory). Sending the statement before the deadline is enough to meet it. The Provider promptly confirms receipt of the statement by email.
  3. The Basic Plan and the AI Plan are digital services which — at the User's express request made at purchase (§ 7(1)(5)) — start immediately after the agreement is concluded. The right of withdrawal expires once the service has been fully performed. A User who withdraws after the service has started pays for the period the Basic Plan or the AI Plan was used until the withdrawal date.
  4. The amount for the period used is proportional: the Billing period fee × the number of started days from the conclusion of the agreement to the day the statement is received ÷ the number of days in the Billing period, rounded down to the nearest grosz. Example: withdrawing from Basic monthly (PLN 14.90, 30-day period) on day 5 — payment PLN 2.48, refund PLN 12.42; from Basic yearly (PLN 119.88, 365 days) on day 5 — payment PLN 1.64, refund PLN 118.24.
  5. The Provider refunds the difference within 14 days of receiving the statement, as described in § 9(5). A paid next period that has not started yet is refunded in full. On withdrawal the Basic Plan or the AI Plan ends, the Account returns to the Free Plan (§ 6(4)) and saved payment methods are removed; the User should stop using the features of the plan that was bought.
  6. The right of withdrawal applies once — from the conclusion of the Subscription Agreement. Renewing a Billing period, paying for the next period (§ 8(2a)), the single payment during the grace period (§ 9(3)) and switching options (§ 8(1)) do not start a new period.
  7. The right of withdrawal under this section does not apply to Companies.
  8. AI credits top-up. The right of withdrawal from an agreement for a top-up of AI credits does not apply (Article 38(1)(13) of the Polish Act on Consumer Rights) if the Provider made the AI credits available with the express and prior consent of the Consumer or Sole trader (section 1), who was informed that the right of withdrawal would be lost (§ 10a(7)), and sent confirmation of that consent on a durable medium (by email).

§ 12. Complaints and conformity of the service

  1. The Provider is liable to Consumers and Sole traders for the conformity of the digital service with the agreement throughout its supply, under Chapter 5b of the Polish Consumer Rights Act of 30 May 2014. As part of this liability the Provider supplies the updates necessary to keep the service in conformity (§ 4(5)).
  2. Complaints can be made by email to info@fabravio.pl, through the "Report a bug" form in the Service or by post to the Provider's address. Please describe the problem, give the Account's email address and say how you would like it resolved; a model form is in Appendix 2 (not mandatory).
  3. The Provider responds to a complaint within 14 days of receiving it, on a durable medium (by email, or by post if the User asks). If the Provider does not respond within that time, the complaint is deemed accepted.
  4. If the service does not conform to the agreement, the User referred to in section 1 may demand that it be brought into conformity. If that is impossible or would involve disproportionate costs, the Provider has not brought the service into conformity, the lack of conformity persists despite attempts to remedy it, or it is so serious as to justify an immediate price reduction or withdrawal, the User may declare a price reduction or withdrawal from the agreement. Withdrawal is not available if the lack of conformity is minor. Refunds are made under § 9(5).
  5. § 14(4) applies to Companies.

§ 13. Acceptable use, illegal content and suspensions

  1. It is prohibited to provide illegal content — in particular content that infringes third-party rights (copyright, personal rights), is offensive or hateful, or promotes violence or crime — including in Project names and descriptions, AI visualization instructions, custom materials and shared links. It is also prohibited to disrupt the Service (attacks, circumventing security), to scrape data automatically, to send spam through the Service, to share an Account with others and to circumvent Plan limits.
  2. Reporting illegal content: anyone may report content available in the Service (e.g. via a Project link) that they consider illegal by writing to info@fabravio.pl, giving: the reasons, the exact address (link) of the content, the reporter's name and email (not required for reports of offences against children), and a statement that the report is made in good faith and the information in it is accurate and complete. The Provider confirms receipt, handles the report promptly, diligently and objectively, and informs the reporter of its decision and of how to challenge it. The Provider does not use automated content moderation.
  3. The Provider may remove or disable access to content that is illegal or breaches these Terms, reset a Project link and, for serious or repeated breaches, suspend the Account for a fixed or indefinite period. Before suspending an Account for breaches other than serious ones, the Provider asks the User to stop them.
  4. A User affected by a decision under section 3 receives by email a statement of reasons setting out: the type and scope of the decision, the facts and circumstances, the ground (a provision of these Terms or of law) and the available redress. An appeal can be made to info@fabravio.pl within 6 months; it is reviewed by a human within 14 days. The User may also use a certified out-of-court dispute settlement body under the Digital Services Act, lodge a complaint with the President of the Polish Office of Electronic Communications (UKE) as the Digital Services Coordinator, or go to court.
  5. The Provider may terminate the Account agreement and the Subscription Agreement: with 30 days' notice — for important reasons not attributable to the User (permanent closure of the Service, a legal requirement), by email; with immediate effect — for serious or persistent breaches of these Terms, after an unsuccessful request to stop (no request is needed where the breach consists of providing illegal content of a criminal nature or an attack on the Service).
  6. Suspending an Account pauses Subscription renewals. If a suspension or termination is reversed as unjustified, the Provider extends the paid Billing period by the length of the suspension. For termination not attributable to the User, § 8(6) applies. For suspension or termination due to the User's breach of these Terms, the fee for the current Billing period is not refunded.

§ 14. Liability

  1. The Provider makes every effort to keep the Service running without interruption but reserves the right to technical breaks (updates, infrastructure provider outages). Planned breaks longer than 2 hours are announced in the Service in advance.
  2. The Provider is not liable for the content of Projects or for how Users share them, nor for the consequences of decisions made solely on the basis of the Service's output without checking it (§ 10(6)), to the extent permitted by law.
  3. In relation to Consumers and Sole traders, these Terms do not exclude or limit the Provider's liability or any rights under mandatory law.
  4. In relation to Companies, the Provider's contractual liability is limited to actual loss and to the fees the Company paid for the Basic Plan, the AI Plan and AI credits top-ups in the 12 months before the event causing the loss, and remedies for lack of conformity are limited to bringing the service into conformity or refunding a proportional part of the fee. These limitations do not apply to damage caused intentionally.

§ 15. Personal data and cookies

  1. The controller of personal data is the Provider. The processing rules, recipients of data, retention periods and Users' rights are described in the Privacy policy, available in the Service's footer.
  2. The use of cookies and similar technologies is described in the Privacy policy; you can change your choice at any time via "Cookie settings" in the Service's footer.
  3. The Provider uses technical measures to protect data: encrypted connections (HTTPS), database-level permissions, signature verification of payment notifications and email address confirmation.

§ 16. Changes to the Terms

  1. The Provider may change these Terms for important reasons: changes in law or in decisions or rulings of authorities; changes in the scope or manner of providing services (adding, changing or removing features, changing the Payment operator or providers); price changes (§ 8(5), § 10a(1), § 10b(3)); security; improving clarity.
  2. The Provider informs Users with an Account of a change by email and in the Service at least 14 days before it takes effect (price changes — 30 days). Changes that are solely favourable to Users or required by law may apply sooner.
  3. A User who does not accept the changes may delete the Account or turn off automatic renewal before they take effect; in that case the previous Terms apply until the end of the current Billing period.
  4. A change does not affect rights acquired before it takes effect, in particular a paid Billing period.
  5. The "Terms" page shows the version and the effective date. A buyer receives the Terms as at the time of purchase by email (§ 7(2)); the Provider sends any earlier version free of charge on request to info@fabravio.pl.

§ 17. Disputes and final provisions

  1. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code, the Consumer Rights Act and the Act on providing services by electronic means. This choice of law does not deprive a Consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence.
  2. A Consumer may use out-of-court complaint and redress procedures: the help of a district (municipal) consumer ombudsman, consumer organizations (e.g. Federacja Konsumentów), mediation or a permanent consumer arbitration court at a voivodeship Trade Inspection office. The Provider agrees to take part in mediation and in proceedings before the permanent consumer arbitration court at the Małopolska Voivodeship Inspector of Trade Inspection in Kraków. Information and the register of bodies: www.uokik.gov.pl.
  3. Disputes with Companies are resolved by the court with jurisdiction over the Provider's registered address. Disputes with Consumers and Sole traders are resolved by the court with jurisdiction under general rules.
  4. These Terms are available in Polish (fabravio.pl) and English (fabravio.com). The Polish version is binding; the English version is a translation.
